Click here to listen! | | | | | | What is a sync agent? A sync agent can be a person or a company that specializes in getting music placed in TV, Films and Games. A sync agent has a relationship with music supervisors, directors and producers. Sync agents/agencies are trusted to deliver quality music that has been properly cleared for placement in projects.
Contacting sync agents and sync companies does make a lot of sense as the next step for artists, bands and songwriters that have properly claimed their own intellectual property. Artists, bands and songwriters that are positioned for sync licensing own their own music and control their own publishing which is key to sync license clearances. Artists, bands and songwriters that have their metadata organized and registered properly are ready to collect all available royalties when they do land a license, that is, if they do not relinquish their publishing.
Some music libraries have re-branded themselves as sync agencies. They can be useful when it comes to getting some sync placements. The downside is finding a trust worthy library because some libraries will re-title the tracks and submit them for placement and call the track a derivative work. This is not exactly ethical. So be vigilant if you choose to pursue music libraries, sync agents, and sync agencies and ask questions. In some cases, they will not re-title the song, but they will take 100% of your publishing/control of your music for a period of years. Make sure to pay attention to the term (how many years will they control your music publishing). How do you re-claim your music publishing after the term? What is the process to re-claim your publishing?
We like to see deals that are non-exclusive with a 2-year term that includes a window of 90 days to re-claim your publishing. The term is tricky because if you do not send the music library/sync agency a termination notice prior to the expiration you will lose control of your publishing (control of your music) for another set number of years based on the agreement. This can easily turn into many years if you are not careful. If you and your bandmates split the publishing it will be very important that bandmates, send the termination letter together with all of your signatures so you can get your publishing back.
Why is it important to keep and/or get your publishing back? Because that is where the long-term revenue is $$$. Publishing is where the money is when you get a song licensed. If you are not collecting the publishing than you are missing out on re-occurring royalties. If you are willing to give up those royalties for a period of years for an opportunity at a license than you must mark the calendar and make sure to send that termination notice prior to the expiration.
| | How do I license my music? Great question! There are some steps to take to get your music ready to license. You do want to have your music ready, because speed counts when it comes to licensing music. ▪ | Confirm writer names and splits, publisher names and splits, performing rights organizations (ASCAP, BMI, PRS, etc.) for writers and publishers. |
▪ | Splits meaning if you have 4 writers on a song and you split the song evenly, each writer has 25% (which adds up to 100%) for the writer share. If each writer has their own publisher, it's very likely the publishing splits would also be 25% each (which adds up to 100%). |
▪ | Who owns the master/copyright? Does a record label or do you own your master/copyrights? |
▪ | Are there any samples? Have you sorted out the writer, publisher, and/or master splits with the publisher(s) and master owner of the song you sampled? It is your job to know and if you don't, the music supervisor will move on because they need to be certain they can clear the song without any conflicts. Remember speed counts so have your ducks in order! |
▪ | Is there a TV/FILM/GAME that you are interested in submitting your music to? Do some research and find the music supervisor or the folks that are in the music clearance department. Send a high quality recording that can be downloaded or streamed via a reliable file sharing company. |
